Article 1 : Champ d’application

These general terms and conditions of sale apply exclusively to all sales concluded via the website ludospherik-editions.com from Éditions Ludospherik.

These general terms and conditions of sale are expressly approved and accepted by the customer, who declares and acknowledges that they are fully aware of them, and thereby waives the right to rely on any contradictory document, in particular their own general terms and conditions of purchase, as the act of purchasing implies acceptance of these general terms and conditions of sale.

Article 2: Contract

The Customer declares that he/she is of legal age and has full legal capacity to enter into commitments under the GTCS, or is acting under the supervision and with the consent of a person with parental authority.

Article 3: Availability of items

Product offers are valid as long as they are visible on the site ludospherik-editions.com, within the limits of available stocks.

Article 4: Prices

Books in paper and digital format are sold in accordance with the applicable provisions, in particular Law no. 81-766 of 10 August 1981 on book prices and Law no. 2011-590 of 26 May 2011 on digital book prices and its implementing decree no. 2011-1499 of 11 November 2011. Pursuant to these provisions, the price of books is set by each publisher. The price is indicated for each of the works in paper and digital format appearing in the Site's electronic catalogue, in euros inclusive of all taxes (VAT + other taxes) excluding shipping costs, which are invoiced in addition.
The section of the Site relating to these costs specifies the methods of shipment, their rates and the indicative times associated with each destination. Any order delivered outside of France may be subject to taxes and customs duties, which are the responsibility of the Customer. Ludospherik cannot be held responsible for the application or the amount of customs duties or taxes.
The selling price of the books is that in force on the day of the order and may be modified at any time by the publishers. The total amount due by the Customer, excluding customs duties and taxes other than VAT, is indicated before the order is validated.

Article 5: Delivery charges

Shipping costs include a contribution towards preparation, packaging and postage costs.

Article 6: Retention of title

The transfer of ownership of the products to the customer will only take place after full payment of the price by the customer, in principal and accessory, whatever the date of delivery of the said products. On the other hand, the risk of loss and deterioration of the products will be transferred to the customer as soon as they are dispatched.

Article 7: Payment by credit card.

The site ludospherik-editions.com offers payment by credit card, secured by SSL. The elements of securing exchanges implemented as part of the secure payment are as follows: integrity of data exchanged between the server and the site ludospherik-editions. com and the bank's server ensured by a sealing method, authentication of the merchant issuing the payment request, confidentiality of data exchanged between the buyer and the bank's payment server (number and date of validity of the credit card, entry of the visual cryptogram) ensured by SSL encryption, direct entry of credit card details on the bank's secure site, ensuring that neither ludospherik-editions.com, nor any technical intermediary will have knowledge of information concerning the credit card.

Article 8: Delivery

The Products will be delivered to the address indicated by the Customer when placing the order. The times indicated are average times and correspond to the processing and delivery times for products destined for mainland France.

Article 9: Product quality - Product conformity

The products we sell are new and guaranteed against any defect when they leave our warehouse. If a product sent to us is faulty, it is the customer's responsibility to return it to us as soon as possible, and no later than 15 days after receipt of the parcel, with the invoice or delivery note to the following address: Éditions Ludospherik, Le Petit Nice, bât. A, Chemin du Four, 13100 Aix-en-Provence. We will cover the cost of returning and re-sending the exchanged item. Return postage will be reimbursed up to the cost of standard postage. The faulty product will be replaced as quickly as possible, and no later than one month after the faulty item is returned. If the product in question is no longer available, it will be reimbursed within 15 days of the customer's complaint.

Article 10: Right of withdrawal

In accordance with article L.121-20 of the French Consumer Code, the individual customer has a period of seven clear days from receipt of the product to exercise their right of withdrawal without having to justify their decision or pay any penalties, although the cost of sending and returning the goods remains at their expense. When the seven-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day. Only the price of the product(s) purchased will be refunded. The product must be in perfect condition and unopened. Items returned incomplete, damaged or soiled by the customer are not included. The return will be refused by Ludospherik and the product returned to the customer who will remain the owner. 

Article 11: Intellectual property

All texts, comments, works, illustrations and images reproduced on the site are protected by copyright and all other intellectual property rights worldwide. As such, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorised. Any total or partial reproduction of the site without prior authorisation is strictly prohibited.

Article 12: Personal data

ludospherik-editions.com undertakes not to disclose to third parties the information provided by the customer. These are confidential. It will only be used to process the order and to strengthen and customize communication and the offer to customers including newsletters to which the customer has subscribed and as part of the customization of the site based on his interests. In accordance with the French Data Protection Act of 6 January 1978, customers have the right to access, rectify and object to any personal data concerning them. To exercise this right, the customer simply needs to contact ludospherik-editions.com, indicating his or her surname, first name, address, e-mail address and, where applicable, customer number: by e-mail to contact@ludospherik-editions.com.

Article 13. Applicable law

Sales of Products are subject to French law. The Site, the GCS and the Orders placed via the Site and their execution are governed exclusively by French law. Any dispute relating to the interpretation or performance of the GTCS or an Order shall be judged in accordance with French law and shall fall within the jurisdiction of the court in the Customer's place of residence or, at the Customer's option, the place of actual delivery of the Product.

Article 14: Customer acceptance

These general terms and conditions of sale and the price list are expressly approved and accepted by the customer, who declares and acknowledges that he/she is fully aware of them. The customer hereby waives the right to invoke any contradictory document, in particular its own general terms and conditions of purchase. The act of purchasing implies acceptance of these general terms and conditions of sale.
